These terms govern your use of equipvora.shop and any order you place through it. By
placing an order you accept them.

Who we are

equipvora.shop is operated by [LEGAL COMPANY NAME NOT SET]. Our contact details are in the footer of every page and on
the contact page.

Orders and acceptance

Adding a machine to the basket and paying is an offer to buy. A contract forms when we send you
an order confirmation email. If we cannot fulfil an order — a stock error, a pricing error,
or an address we cannot ship to — we will tell you and refund you in full.

We reserve the right to refuse or cancel any order, including after payment, in which case the
full amount is refunded to the original payment method within 14 days.

Pricing errors

We take care with prices, but if a machine is listed at an obviously incorrect price we are not
obliged to sell it at that price. We will contact you, explain, and give you the choice of paying
the correct price or being refunded in full.

Descriptions and specifications

Every specification on this site is either taken from the manufacturer’s data, read off the
machine, or converted from the manufacturer’s metric figure into US units. Photographs show the
machine as supplied. Manufacturers do change specifications; where a figure is critical to your
decision, ask us to confirm it in writing before you order and that written confirmation is what
we stand behind.

Where we have not been able to confirm a figure, it is absent from the page rather than
estimated.

Your responsibilities as an operator

These are powered machines that can injure or kill. You are responsible for:

• Reading the manual before operating.
• Operator training and competence. For commercial use OSHA requires operators to be trained and
  competent for the equipment they operate. We supply the manual; we do not provide certification.
• Appropriate personal protective equipment.
• Calling 811 before any digging. It is free and it is required in every state.
• Checking towing capacity, tongue weight, trailer GVWR and your state’s requirements before
  towing a machine.
• Site safety, including overhead lines, buried services and bystanders.

Warranty and limitation of liability

Our written limited warranty is set out in full on the
returns and warranty page and forms part of these terms.

To the fullest extent permitted by law, and except where a state law provides otherwise, our
total liability arising out of or relating to any order is limited to the amount you paid for the
machine in question. We are not liable for indirect or consequential losses, including lost
profits, lost work, downtime or the cost of renting a replacement machine.

Nothing in these terms excludes or limits liability for death or personal injury caused by our
negligence, for fraud, or for anything else that cannot lawfully be excluded. Some states do not
allow the exclusion or limitation of incidental or consequential damages, so parts of the above may
not apply to you.

Intellectual property

The content of this site — text, photography, layout and the EquipVora name and mark —
belongs to [LEGAL COMPANY NAME NOT SET] and may not be reproduced without permission.

Governing law

These terms are governed by the laws of the state in which [LEGAL COMPANY NAME NOT SET] is registered, without
regard to its conflict of law provisions. Nothing here affects your rights under the consumer
protection law of your own state.

Changes

We may update these terms. The version that applies to your order is the version published when
you placed it.
